Welcome to Mixed Handed Branding Social (the "Service"). These Terms of Service ("Terms") govern your access to and use of our Service, which utilizes Meta's Instagram API with Facebook Login. By accessing or using the Service, you agree to be bound by these Terms.

2. Description of Service

Our Service provides a web application that allows users to access and display content from their own Instagram Professional (Business or Creator) accounts. The core functionality includes retrieving and showcasing Instagram posts, photos, and their associated comments on the user's own website .

During the current testing phase, the Service is used exclusively by our internal development team and accesses data solely from our own Meta business account. Testing pages are de-listed from public access.

3. Meta Platform Compliance

Your use of our Service is also subject to your compliance with Meta's applicable terms and policies. By using this Service, you agree to comply with:

  • The Meta Platform Terms: Which govern your use of Meta's APIs and platform .

  • The Instagram Terms of Use: Which govern your use of Instagram's services .

  • Meta's Developer Policies: Which outline the rules for building apps on Meta's platform .

  • Meta's Community Standards: Which define what is and isn't allowed on their platforms .

We are not responsible for your non-compliance with any of Meta's terms.

4. Intellectual Property

  • Instagram Content: All Instagram content, including posts, photos, and comments, accessed through our Service remains the sole property of the respective rights holders. You are solely responsible for ensuring your use of this content complies with the owners' requirements or restrictions .

  • Our Service: All rights, title, and interest in and to our Service (excluding third-party content) are and will remain our exclusive property.

5. Data Usage and Privacy

Your privacy is important to us. Our Privacy Policy explains in detail how we collect, use, and protect data accessed via the Instagram API. By using this Service, you agree to the collection and use of information in accordance with our Privacy Policy.

In line with Meta's Platform Terms, we strictly adhere to the following data practices :

  • We will not sell, license, or purchase any data obtained from the Instagram API.

  • We will not use Platform Data to perform, facilitate, or provide tools for surveillance.

  • We will not use Platform Data to make eligibility determinations about people (e.g., for housing, employment, insurance, etc.).

  • We will not use Platform Data to discourage people based on personal attributes such as race, ethnicity, or gender.

6. User Responsibilities and Restrictions

You agree not to use the Service to:

  • Impersonate others or provide inaccurate information.

  • Engage in any unlawful, misleading, or fraudulent activities.

  • Violate these Terms, or encourage others to do so.

  • Interfere with or impair the intended operation of the Service.

  • Attempt to create accounts or access data in unauthorized ways.

  • Post private or confidential information without permission or infringe on someone else's rights, including intellectual property rights .

7. Data Retention and Deletion

We only store or cache Instagram data for the period necessary to provide the Service's functionality . Users may request modification or deletion of their data by contacting us using the information in the "Contact Us" section. We will comply with such requests and with Meta's requirements to delete data promptly.

8. Termination

We may suspend or terminate your access to the Service immediately if you fail to comply with these Terms or any applicable Meta policies. Meta also reserves the right to suspend or terminate our app's access to its platform for non-compliance.

9. Disclaimer of Warranty; Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.
